Welcome to Gemini 3 Pro Image Preview ("Service"). These Terms of Service ("Terms") are a legally binding agreement between you ("Customer") and Gemini 3 Pro Image - No Signup Required. By accessing or using the Service you accept these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

1. Service Description

Gemini 3 Pro Image Preview provides:
- Multi-turn image generation and editing from text and mixed media prompts
- Text-and-image interleaving for grounded storytelling
- Configurable aspect ratios plus 1K, 2K, and 4K outputs
- Optional paid Google Search grounding signals
- Batch prediction APIs with dynamic shared quotas
- Preconfigured throughput pools exposed via a single global endpoint
- Dashboard, SDKs, and command-line tooling for orchestration

2. Accounts & Eligibility
- You must be at least 13 years old to use the Service (18+ to enter paid contracts in most regions)
- Registration may require accurate contact, billing, and organization details
- You are responsible for safeguarding credentials and for activity under your account
- We may refuse or terminate accounts for violation of these Terms or applicable laws

3. Subscription Plans & Payment
- Free and paid tiers may exist; features, quotas, and throughput differ per plan
- Paid plans require a valid payment method; you authorize recurring charges until canceled
- Fees are non-refundable unless required by law; downgrades take effect at the next billing cycle
- Taxes, currency conversion fees, or bank charges are your responsibility
- Usage above plan quotas may incur overage fees; we will notify you when practicable

4. Acceptable Use
You agree not to:
- Violate any law, regulation, or third-party rights
- Generate or disseminate content that is illegal, exploitative, hateful, or deceptive
- Create misleading deepfakes intended for fraud, impersonation, or election interference
- Attempt to disable, overload, or reverse engineer the Service or underlying models
- Circumvent safety systems, rate limits, or quota enforcement
- Use outputs to train competing foundation models without our written consent
- Submit malicious code, unauthorized data, or content containing personal information you do not have rights to process

We may filter, block, or remove content that violates these rules or our safety policies.

5. Customer Content & Ownership
- "Customer Content" includes prompts, reference images, edits, fine-tuning files, and resulting outputs that you submit or receive
- You retain all rights to Customer Content except for the limited license granted to us to operate and improve the Service
- You grant us a worldwide, non-exclusive license to host, process, transmit, and display Customer Content solely to provide the Service, enforce policies, and comply with law
- You are solely responsible for Customer Content, including obtaining necessary permissions and ensuring compliance with all laws

6. Model Outputs
- Unless a written agreement states otherwise, you own the model outputs generated for you
- Outputs may be subject to third-party rights (e.g., when you provide reference material). You must ensure your downstream usage is lawful
- We may store outputs for quality assurance, debugging, or safety reviews per our retention schedule

7. Safety, Grounding, and Human Review
- Prompts may be automatically scanned for abuse, malware, or policy violations
- When you enable paid Google Search grounding, relevant snippets are shared with Google subject to their terms
- We may conduct human review of flagged content to enforce safety and legal requirements
- We may pause or terminate access if we detect suspicious activity or receive credible complaints

8. Service Availability & Global Endpoint
- The Service is delivered via a global endpoint with preconfigured throughput allocations
- We make commercially reasonable efforts to keep the Service available but do not guarantee uninterrupted access
- Planned maintenance or emergency downtime may occur; we will post notices when feasible
- Model versions, latency, and features may change; major deprecations will include advance notice

9. Feedback
- If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you

10. Third-Party Services
- We may integrate with third-party APIs (e.g., Google Search) or deployment platforms
- Third-party terms may apply when you enable those integrations; we are not responsible for their services

11. Confidentiality
- Each party agrees to protect the other party’s confidential information with reasonable care
- Customer Content is treated as confidential except as authorized in these Terms
- Confidentiality obligations do not apply to information that is public, previously known, independently developed, or rightfully received from another source

12. Disclaimers
- The Service is provided "as is" and "as available"
- We make no warranties about output accuracy, originality, or fitness for a particular purpose
- AI outputs may contain errors, hallucinations, or bias; you must review before relying on them

13. Limitation of Liability
- To the maximum extent permitted by law, Gemini 3 Pro Image - No Signup Required will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data
- Our aggregate liability for claims arising out of or relating to the Service is limited to the greater of (a) $100 USD or (b) the amount you paid us in the 12 months preceding the event giving rise to the claim

14. Indemnification
- You agree to indemnify and hold harmless Gemini 3 Pro Image - No Signup Required, its affiliates, and personnel from any claims, losses, or expenses arising from your Customer Content, use of the Service, or breach of these Terms

15. Suspension & Termination
- We may suspend or terminate access if you breach these Terms, pose a security risk, or fail to pay fees
- You may terminate anytime by closing your account; fees already paid are non-refundable unless required by law
- Upon termination, your right to use the Service stops immediately, and we may delete Customer Content after a reasonable period subject to legal requirements

16. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law principles
- Disputes will be resolved in the state or federal courts located in San Francisco County, California, unless prohibited by law
- Each party waives the right to a jury trial or to participate in a class action to the extent permitted by law

17. Changes to These Terms
- We may update these Terms to reflect feature changes or legal requirements
- Material changes will be announced via email or in-product notices; continued use after the effective date constitutes acceptance
